3. Categories of Information We Collect
3.1 Personal Information
We may collect your full name, email address, phone number, business information, and government or professional identifiers for healthcare providers.
3.2 Sensitive Personal Data
Depending on the module used, we may process healthcare data, including medical records, diagnoses, prescriptions, and patient identifiers. This data may be subject to HIPAA, the General Data Protection Regulation (GDPR), and other health and data protection laws that apply where the data is processed.
3.3 Financial and Transaction Data
We may collect transaction records, billing history, and subscription data. Payment card details are processed by third party payment processors, including Stripe, and are not stored on our systems.
3.4 Operational and Business Data
We may collect logistics data such as orders and deliveries, restaurant inventory and sales data, retail operations data, energy usage and analytics data, and digital twin simulation data.
3.5 Technical Data
We may collect IP addresses, browser type, device identifiers, usage logs, and data from cookies and similar technologies.
3.6 AI and Analytics Data
We may collect user interactions with AI systems, usage patterns, and predictive analytics inputs and outputs.
4. How We Collect Information
We collect data through direct user input, automated technologies such as cookies and logs, third party integrations, and APIs and system to system connections.
5. How We Use Your Information
5.1 Provide Services
We use data to operate EMR systems, restaurant and retail operations platforms, logistics and delivery services, marketplace transactions, and energy analytics and digital twin insights.
5.2 Improve the Platform
We use data to develop, train, and improve AI models, enhance system performance, and develop new products and features.
5.3 Legal and Compliance
We use data to meet regulatory requirements, enforce our Terms of Service, and prevent fraud and abuse.
5.4 Communication
We use data to send service updates, provide customer support, and deliver important notifications, including account security notices by email.
6. Legal Basis for Processing
Where required by law, we process data based on user consent, contractual necessity, legal obligations, or legitimate business interests.

We do not sell personal information in exchange for money. Mobile phone numbers and messaging consent data are never shared as described in this section, and are handled only as stated in Section 19. Subject to that exclusion, we may share your data with:

Including DoorDash for logistics fulfillment.

In connection with a merger, acquisition, or asset sale.
7.5 Legal Requirements
When required by court order, government authorities, or law enforcement.
8. Data Retention
We retain data for as long as necessary to provide the Services, comply with legal obligations, and support legitimate business purposes. Healthcare data may be retained longer in accordance with medical regulations. When data is no longer needed, we delete or deidentify it. Retention and deletion for Education Customers are described in the ChiwiQ Education Addendum.
9. Data Security
We implement safeguards that include encryption in transit and at rest, access controls, multi factor authentication for administrative access, and access logging. No system is completely secure.
10. Your Rights
Subject to applicable law, you have the right to:
- Access your personal information
- Correct inaccurate information
- Delete your personal information
- Restrict or object to processing
- Receive a portable copy of your information
- Withdraw consent where processing is based on consent
Depending on where you live, you may have additional rights under local law.
How to make a request: email info@chiwiq.com. We may need to verify your identity before acting on a request. We will respond within 45 days, or sooner where required by law. If we decline a request, we will explain why, and you may appeal by replying to our response.
If you use the Platform through a business or school customer, we may refer your request to that customer.
11. Cookies and Tracking Technologies
We use cookies to operate the Platform, improve user experience, analyze traffic, and personalize content. You can control cookies through your browser settings and, where available, our cookie preference tools. Cookies do not collect mobile phone numbers or messaging consent data. 12. International Data Transfers
Your data may be transferred to, stored in, and accessed from the United States and other countries where ChiwiQ, its personnel, contractors, or service providers operate. We use safeguards such as data protection agreements and, where required, standard contractual clauses. Data for Education Customers is hosted in the United States, as described in the ChiwiQ Education Addendum.
13. AI and Automated Decision Making
ChiwiQ may use AI to generate insights, automate workflows, and provide recommendations. AI outputs may not be fully accurate, and human oversight is required.
14. Children's Privacy
The Platform is not intended for individuals under 13. We do not knowingly collect data from children under 13 without parental consent. If we learn we have done so, we will delete it.
Where students use the Services through a school or other educational institution, the ChiwiQ Education Addendum (https://www.chiwiq.com/legal/education-addendum) also applies.
15. Third Party Links
The Platform may contain links to third party websites. We are not responsible for their privacy practices.
16. Changes to This Privacy Policy
We may update this Policy at any time. Changes will be posted with an updated "Last updated" date.

19. SMS Communications
ChiwiQ LLC sends text messages to customers who place orders through the Platform and opt in by checking the SMS consent box at checkout. Messages are limited to order confirmations and order status, pickup, and delivery updates. Account security notices are sent by email, not text message.

Mobile information
We collect your mobile phone number and messaging consent only to send the messages you requested. We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. Mobile phone numbers may be shared only with service providers, such as Twilio, that deliver messages on our behalf. All other sections of this Policy exclude text messaging originator opt in data and consent; this information will not be shared with any third parties.
20. Supplemental Provisions
20.1 United States
ChiwiQ complies with HIPAA where applicable, and with applicable U.S. state privacy laws. Residents of states with consumer privacy laws may exercise the rights in Section 10, including the right to appeal a decision.
20.2 European Economic Area and United Kingdom
Where the GDPR or UK data protection law applies, ChiwiQ supports data subject rights, conducts data protection impact assessments where required, and relies on lawful bases for processing. You may also lodge a complaint with your local data protection authority.
20.3 Other Jurisdictions
Where local data protection laws provide additional rights or requirements, ChiwiQ will comply with them to the extent they apply.
20.4 Education Customers
Schools and other educational institutions are subject to the ChiwiQ Education Addendum, available at https://www.chiwiq.com/legal/education-addendum, which controls where it conflicts with this Policy.

By using ChiwiQ, you acknowledge that you have read and understood this Privacy Policy, consent to the collection and use of your information as described, and accept the risks associated with digital data processing.
